This essay discusses possibilities and requirements for realizing the right to education, critically observing the obstacles presented by an unequal world. Proposing that education as a right be studied through three concepts – education as a consecrated right, education as a decreed right, and education as a practiced right –, it is to the latter that the article attributes analytical protagonism. Recognizing the centrality of the meritocratic ideology promoted by contemporary educational policies, the text concludes that we find ourselves in a process of transition from a democratic pedagogy, never fully realized and successful, to a meritocratic, entrepreneurial and anti-other pedagogy. Meritocracy is considered, in relation to education as a practiced right, one of the biggest obstacles faced, capable of producing new inequalities and causing a strong erosion of democracy and democratic pedagogy in education.
