The Corporate Citizen: A Critique of Klaus Günther’s Discourse Theory of Responsibility

ABSTRACT

Klaus Günther proposes a theory about the democratic legitimacy of Law based on the idea of deliberative person as the bond between subject of law and co-legislator. This paper explores the consequences to the legitimacy of law of the fact that group agents can be deliberative persons, concluding that the theory needs to be reviewed to justify not granting fundamental political rights to group agents.
