Legal research involving human subjects: central role of Ethics Committees and strict interpretation of exceptions Vasconcellos, Vinicius Gomes de Amaral, Maria Eduarda Azambuja

Resumo Este editorial discute a relevância da ética em pesquisa, com especial atenção ao papel dos Comitês de Ética em Pesquisa (CEPs) nas Ciências Humanas e Sociais. Apresenta-se uma breve contextualização histórica da institucionalização do controle ético em pesquisas com seres humanos, destacando a consolidação do sistema CEP/CONEP no Brasil e as especificidades da pesquisa jurídica pela Resolução CNS n. 510/2016. Analisam-se os principais aspectos procedimentais da submissão de projetos, especialmente quanto ao consentimento livre e esclarecido, à proteção da privacidade e ao tratamento de dados pessoais. O texto também enfrenta a resistência existente nas pesquisas jurídicas quanto à submissão dos projetos aos CEPs, frequentemente baseada em interpretações ampliativas das hipóteses de dispensa. Embora existam divergências e posições ampliativas adotadas por revistas relevantes, sustenta-se que tais exceções devem ser interpretadas restritivamente, sobretudo em pesquisas que envolvam entrevistas com operadores do sistema de justiça, em razão dos riscos institucionais, reputacionais e informacionais. Conclui-se que o fortalecimento da ética em pesquisa no Direito exige a incorporação efetiva do controle ético como etapa regular da produção científica, dialogando com os direitos fundamentais, os valores constitucionais e a responsabilidade social da academia.

Abstract This editorial discusses the relevance of ethics in research, with special attention to the role of Research Ethics Committees (RECs) in the Humanities and Social Sciences. It presents a brief historical overview of the institutionalization of ethical control in research involving human subjects, highlighting the consolidation of the CEP/CONEP system in Brazil and the specificities of legal research under CNS Resolution No. 510/2016. It analyzes the main procedural aspects of project submission, especially regarding free and informed consent, privacy protection, and personal data processing. The text also addresses the resistance that exists in legal research to submitting projects to CEPs, often based on broad interpretations of the grounds for exemption. Although there are divergences and broader interpretative positions adopted by leading journals, it is argued that such exceptions should be construed restrictively, particularly in research involving interviews with actors within the justice system, given the associated institutional, reputational, and informational risks. It is concluded that strengthening research ethics in law requires the effective incorporation of ethical control as a regular stage of scientific production, in dialogue with fundamental rights, constitutional values, and the social responsibility of academia.

Resumo A inteligência artificial representa um caminho inteiramente novo, uma incursão fulgurante em territórios nunca antes mapeados, o que, em si mesmo tomado, encerra uma pletora de candentes desafios que não deverá deixar ninguém indiferente. No que tange a tecnologia de ponta, não se deve confiar plenamente na sorte – sequer no bambúrrio. A inteligência artificial, apesar das suas múltiplas vantagens, não está isenta de uma miríade de preocupantes inconsistências e de inultrapassáveis insuficiências. De entre as quais se respiga a discriminação algorítmica que resulta da utilização de algoritmos preditivos discriminatórios no âmbito do processo penal, o que poderá derruir as bases fundacionais em que se estriba a justiça algorítmica. Pode afirmar-se, sem surpresa de monta, que a Inteligência Artificial avoca, nas suas mãos tremeluzentes, o destino da humanidade, atento o potencial disruptivo que encerra. Está fundamentalmente em causa a emergência de novas – e profundamente disruptivas – formas de intrusão nas nossas vidas quotidianas que são, em si mesmo tomadas, insuscetíveis de ser acurada e proficientemente antecipadas no momento atual que nos interpela. É com este pano de fundo que florescem as candentes questões: deverão os operadores judiciários (i.e., juízes, procuradores e advogados) confiar plenamente na avaliação algorítmica do risco em processo penal? Por outro lado, deveremos confiar à Inteligência Artificial o múnus de realizar decisões que podem afectar seriamente o núcleo essencial dos direitos fundamentais dos cidadãos? Tendo em linha de conta as aporias acima assinaladas, este texto conclui que à inteligência artificial não deverá atribuído o poder de decidir questões de supina importância em processo penal (i.e. o direito a um processo justo e equitativo, um esteio essencial do processo penal moderno), sob pena de consequências danosas irreversíveis (e.g. a perda de reputação funcional do sistema de administração de justiça penal).

Abstract Artificial Intelligence-embedded technologies represent a blazingly new path, a foray into uncharted territory that holds a wealth, and a treasure trove, of scorching challenges that should not leave anyone lukewarm. When it comes to cutting-edge technology, you better not try your luck and the let the chips fall where they may. Artificial Intelligence-embedded technology, albeit a seemingly bedazzling gift to humankind, is not without multifarious caveats. Amongst which stands a slew of perceived perils arising out of biased algorithm risk assessment in criminal justice settings that is shaping up to topple the foundations upon which stands algorithmic fairness. Hardly any bewildering surprise stems from the fact that Artificial Intelligence-embedded technology holds the blueprint of our destiny and the disruptive power it carries. This is about the unfolding of newer and higher forms of intrusiveness in our daily lives that extend beyond our collective grasp. Building upon this, a couple of vexing questions crop up with bursting unease: should relevant stakeholders (i.e. judges, prosecutors, and lawyers) rely upon algorithmic risk assessment (i.e. COMPAS) in the purview of criminal justice? On the flip side, should machines be entrusted with the task of making high-stake decisions in the realm of criminal procedure law settings? Bearing these burning (research) questions very firmly in mind, this paper adamantly contends that machines should not wield the power of making high-stake decisions that may bear heavily on citizens’ fundamental rights (i.e. the right to a due process, a central tenet of criminal procedure law) or inordinate harms may otherwise occur (i.e. the loss of functional reputation of the system of administration of justice).

Resumen El problema central de esta investigación es la ineficacia del derecho penal tradicional para enfrentar la criminalidad ambiental. Este modelo, centrado en el castigo, demuestra sus limitaciones al relegar a un segundo plano la reparación del daño, la prevención o las garantías de no repetición. Ante esta insuficiencia, cabe preguntarse: ¿es el nuevo marco de la justicia restaurativa en España una vía eficaz para lograr la reparación efectiva del daño ambiental? Asimismo, ¿permite este modelo integrar una pluralidad de intereses y actuar sobre las causas estructurales de la criminalidad corporativa en este ámbito? El objetivo principal es explorar la aplicabilidad de la justicia restaurativa, recientemente regulada en la Disposición Adicional 9ª de la Ley de Enjuiciamiento Criminal española, a los delitos medioambientales. La hipótesis del trabajo es que la nueva normativa penal española ofrece una oportunidad estratégica para que la justicia restaurativa logre soluciones más eficaces, flexibles, participativas y sostenibles en el ámbito de la criminalidad medioambiental que una intervención meramente punitiva. La metodología se basa en un análisis dogmático y jurídico-comparativo, empleando un enfoque analítico-funcional para contrastar el paradigma punitivista tradicional con la justicia restaurativa. El estudio se centra en la nueva regulación normativa, utilizando como criterios de análisis la capacidad de respuesta de ambos modelos ante la especificidad del daño ambiental y su eficacia en la reparación efectiva del entorno.

Abstract The central problem of this research is the ineffectiveness of traditional criminal law in addressing environmental crime. This punishment-centered model reveals its limitations by relegating damage reparation, prevention, and guarantees of non-repetition to the background. Given this insufficiency, the following questions arise: Is the new framework for restorative justice in Spain an effective way to achieve meaningful reparation for environmental damage? Furthermore, does this model allow for the integration of a plurality of interests and address the structural causes of corporate environmental crime? The main objective is to explore the applicability of restorative justice, recently regulated in the 9th Additional Provision of the Spanish Criminal Procedure Act, to environmental offenses. The working hypothesis is that the new Spanish criminal regulations offer a strategic opportunity for restorative justice to achieve more effective, flexible, participatory, and sustainable solutions in the field of environmental crime compared to a merely punitive intervention. The methodology is based on a dogmatic and legal-comparative analysis, employing an analytical-functional approach to contrast the traditional punitivist paradigm with restorative justice. The study focuses on the new regulatory framework, using the responsiveness of both models to the specificity of environmental damage and their efficacy in the effective restoration of the environment as analytical criteria.

Resumo A presente pesquisa se justifica para tornar acessíveis as contribuições de Pontes de Miranda ao processo penal, frequentemente invisibilizadas por barreiras tecnológicas e editoriais. A problemática central é formulada do seguinte modo: por que as ideias de Pontes de Miranda sobre o processo penal, apesar de atuais e relevantes, permanecem pouco difundidas entre processualistas penais? A hipótese é a de que tal invisibilidade decorre não de obsolescência teórica, mas da falta de acessibilidade digital e da predominância de referências estrangeiras na doutrina. O objetivo é analisar criticamente as principais concepções de Pontes de Miranda sobre o processo penal, como a natureza da ação penal, a distinção entre sistemas inquisitório e acusatório, a defesa do habeas corpus e da paridade de armas, relacionando-as com valores democráticos e com debates contemporâneos. O método de abordagem adotado é hipotético-dedutivo, utilizando-se de revisão bibliográfica, com releitura de obras centrais de Pontes de Miranda, além de confronto com autores como Carnelutti, Liebman, Aury Lopes Jr. e Jacinto Coutinho. Conclui-se que Pontes de Miranda antecipa discussões, revelando um compromisso com garantias fundamentais e com a contenção do poder punitivo, de modo que sua redescoberta é essencial para fortalecer um processo penal democrático.

Abstract This research is justified to make Pontes de Miranda’s contributions to criminal procedure accessible, as they are often obscured by technological and editorial barriers. The central problem is formulated as follows: why do Pontes de Miranda’s ideas on criminal procedure, despite being current and relevant, remain little known among criminal proceduralists? The hypothesis is that this invisibility stems not from theoretical obsolescence, but from a lack of digital accessibility and the predominance of foreign references in doctrine. The objective is to critically analyze Pontes de Miranda’s main concepts on criminal procedure, such as the nature of criminal action, the distinction between inquisitorial and accusatory systems, the defense of habeas corpus and equality of arms, relating them to democratic values and contemporary debates. The method of approach adopted is hypothetical-deductive, using a bibliographic review, with a rereading of Pontes de Miranda’s central works, in addition to a comparison with authors such as Carnelutti, Liebman, Aury Lopes Jr., and Jacinto Coutinho. It is concluded that Pontes de Miranda anticipates discussions, revealing commitment to fundamental guarantees and the containment of punitive power, so that his rediscovery is essential to strengthen a democratic criminal process.

The habeas corpus procedure in the Court of Justice of the State of Ceará (TJCE) and its influence on the reasonable duration of the process Fernandes, Carlos Eduardo Lima Braga, Italo Farias

Resumo O habeas corpus (HC) é um instrumento processual que visa coibir excessos das autoridades públicas dotadas do uso legítimo da força. O Estado do Ceará carece de dados acerca do atendimento (ou não) do princípio da Duração Razoável do Processo no processamento de habeas corpus criminais. Sendo assim, o presente trabalho tem como objetivo analisar se o Tribunal de Justiça do Estado do Ceará, quanto ao processamento de habeas corpus criminais, aplica, de modo efetivo, o princípio da duração razoável do processo. Para isso, realizou-se uma pesquisa de natureza quali-quantitativa, com apoio do método bibliográfico e documental. Foram encontrados 37.543 acórdãos entre 2009 e 2023, destes, selecionou-se 256 (margem de erro de 5,14%). O tempo médio entre a impetração e o julgamento foi de 61,72 dias, e, a média de atos processuais, do protocolo ao arquivamento, foi de 41,68. Foram providos 16,8% e 2,34% tiveram decisão liminar concedida. A partir da análise dos outliers, concluiu-se que o Tribunal de Justiça do Estado do Ceará não atendeu ao princípio da duração razoável nos biênios 2009-2011 e 2013-2015, contudo, percebeu-se que desde então o Tribunal vem atendendo ao princípio, e diminuindo a cada ano o tempo de julgamento de seus writs.

Abstract in English:

Abstract Habeas corpus (HC) is a procedural instrument that aims to curb excesses by public authorities endowed with the legitimate use of force. The State of Ceará lacks data regarding compliance (or not) with the principle of reasonable process duration in the processing of criminal habeas corpus. Therefore, the present work aims to analyze whether the Court of Justice of the State of Ceará, regarding the processing of habeas corpus criminals, effectively applies the principle of reasonable duration of the process. To this end, qualitative and quantitative research was carried out, supported by bibliographic and documentary methods. 37,543 judgments were found between 2009 and 2023, of which 256 were selected (margin of error 5.14%). The average time between filing and judgment was 61.72 days, and the average number of procedural acts was 41.68, from protocol to filing. 16.8% were granted and 2.34% had an injunction granted. From the analysis of the outliers, it was concluded that the Court of Justice of the State of Ceará did not comply with the principle of reasonable duration in the biennia 2009-2011 and 2013-2015, however, it was noticed that since then the Court has been complying with the principle, and reducing the time for judging their writs every year.

Resumo Comumente traduzidas como “protestos” na legendagem e dublagem de filmes americanos, as objeções se tornaram símbolos populares apropriados por brasileiros que possuem pouca intimidade com a estrutura forense de seu país. No entanto, essas objeções podem ser incorporadas e traduzidas por uma leitura comparada comprometida com os ritos e a legislação nacionais. Tendo isso em vista, este artigo visa ao tratamento dessas objeções, de modo a tentar organizar lições e possíveis compatibilidades que sirvam à inquirição de testemunhas, em especial nos procedimentos voltados ao júri popular. Em suma, este artigo responde ao seguinte problema de pesquisa: seriam tais objeções aplicáveis ao processo penal brasileiro ou, ao menos, capazes de legar contribuições úteis ao seu desenvolvimento, especialmente no controle da prova testemunhal? Como resultado de pesquisa, na conclusão, levanta-se uma lista com 20 itens que traduzem objeções no direito norte-americano e são sintetizadas algumas digressões quanto sua adequação ao procedimento brasileiro e possíveis lições que a jurisdição norte-americana possa fornecer ao controle da prova testemunhal. A hipótese inicial era de que essas objeções eram plenamente aplicáveis aos procedimentos nacionais. Constata-se que, embora a hipótese inicial de plena aplicabilidade das objeções tenha se enfraquecido, algumas lições relevantes podem ser assimiladas, sobretudo no aprimoramento do contraditório e na disciplina da prova testemunhal. O método utilizado foi a revisão bibliográfica de traços dedutivo, exploratório e qualitativo, aliada a uma análise comparada de enfoque funcionalista (Zweigert e Kötz) e de transplantabilidade (Watson e Legrand) das Federal Rules of Evidence e das leis processuais penais brasileiras.

Abstract in English:

Abstract Commonly translated as “protests [in brazilian reality]” in the subtitling and dubbing of American films, objections have become popular symbols adopted by Brazilians with little familiarity with their own country’s forensic structure. However, these objections can be analyzed and reinterpreted through a comparative reading committed to national rites and legislation. With this in mind, this article addresses such objections in order to organize lessons and possible compatibilities applicable to the examination of witnesses, especially in proceedings before the jury court. In sum, this article addresses the following research question: are such objections applicable to Brazilian criminal procedure or, at least, capable of offering useful contributions to its development, particularly regarding the control of testimonial evidence? As a research outcome, the conclusion presents a list of 20 items translating objections from North American law, along with critical remarks regarding their suitability to Brazilian procedure and the potential lessons that U.S. jurisdiction may offer for the control of testimonial evidence. The initial hypothesis assumed that these objections would be fully applicable to national procedures. However, this hypothesis proved substantially weakened by the cultural and procedural differences surrounding objections, although there is, indeed, something to be learned from these institutes. The method employed was a bibliographic review of a deductive and qualitative nature, combined with a comparative analysis adopting a functionalist approach (School of Zweigert and Kötz) and a transplants perspective (School of Watson and Legrand), focusing on the Federal Rules of Evidence and Brazilian criminal procedural law.

Guarantism and Criminal Procedure: a rationality against authoritarianism Pinho, Ana Cláudia

Resumo O presente artigo pretende apresentar a teoria do Garantismo Penal, de Luigi Ferrajoli como uma ferramenta adequada para combater a “lei do mais forte”, isto é, o poder abusivo, sobretudo o poder de punir. A partir de uma racionalidade democrática, o Garantismo constrói um modelo ideal (sistema garantista) que prescreve um dever ser oponível aos modelos autoritários, oferecendo um caminho, caracterizado pela limitação e controle do poder. Para tanto, o artigo partirá de um recorte do termo “autoritarismo”, conforme utilizado por Luigi Ferrajoli, em seu livro Diritto e Ragione: teoria del garantismo penale e, na sequência, demonstrará a necessidade de aproximação dos cenários brasileiro e italiano, das décadas de 1930/1940, a fim de desvelar a influência do fascismo na construção do Código Rocco italiano (1930) e, também, no Código de Processo Penal brasileiro (1941). O texto pretende deixar clara essa relação entre ambos os cenários (italiano e brasileiro) e a Teoria do Garantismo Penal, precisamente porque referida proposta teórica formatou uma epistemologia capaz de apresentar soluções efetivas para enfrentar modelos autoritários de repressão penal.

Abstract in English:

Abstract This article aims to present Luigi Ferrajoli’s theory of Penal Guarantism as an appropriate tool to combat the “law of the strongest,” that is, abusive power - especially the power to punish. Based on democratic rationality, Guarantism builds an ideal model (the guarantist system) that sets forth a normative framework in opposition to authoritarian models, offering a path marked by the limitation and control of power. To this end, the article begins with an analysis of the term “authoritarianism” as used by Luigi Ferrajoli in his book Diritto e Ragione: Teoria del garantismo penale, and subsequently demonstrates the need to draw parallels between the Brazilian and Italian contexts of the 1930s and 1940s, in order to justify the influence of fascism on the construction of the current Brazilian Code of Criminal Procedure. The text aims to clarify this relationship between the two scenarios (Italian and Brazilian) and the Theory of Penal Guarantism, precisely because this theoretical framework has developed an epistemology capable of offering effective solutions to counter authoritarian models of criminal repression.

Resumo O artigo analisa os embargos infringentes nas ações penais originárias julgadas pelas Turmas do Supremo Tribunal Federal, à luz de sua conformação histórica como instrumento de proteção do réu (favor rei) e das restrições interpretativas consolidadas na jurisprudência da Corte. Examina-se a evolução normativa do instituto no processo penal e no Regimento Interno da Corte, bem como a controvérsia relativa à exigência de dois votos divergentes para o seu cabimento. Metodologicamente, trata-se de estudo de natureza dogmático-jurídica, com abordagem qualitativa, fundamentado em revisão bibliográfica, bem como na análise de fontes normativas. Sustenta-se que a solução interpretativa adotada pelo STF, ao introduzir critérios restritivos não expressamente previstos, desloca o problema da recorribilidade para um plano de racionalidade interna da Corte, tensionando a natureza garantista do recurso e seus pressupostos normativos. Conclui-se que tal interpretação suscita questionamentos quanto aos limites da atuação jurisdicional na conformação de requisitos de admissibilidade recursal em matéria penal, especialmente em contextos de instância única.

Abstract This article analyzes infringing appeals in criminal cases originally adjudicated by the Chambers of the Brazilian Supreme Federal Court, in light of their historical development as a mechanism for the protection of the defendant (favor rei) and the restrictive interpretations consolidated in the Court’s case law. It examines the normative evolution of this remedy within criminal procedure and in the Court’s Internal Rules, as well as the controversy surrounding the requirement of two dissenting votes for its admissibility. Methodologically, the study adopts a dogmatic legal approach with a qualitative orientation, grounded in bibliographical review and the analysis of normative sources. It argues that the interpretive solution developed by the Court, by introducing restrictive criteria not expressly provided for, shifts the issue of appealability to a plane of internal institutional rationality, thereby placing tension on the guarantee-oriented nature of the remedy and its normative foundations. The article concludes that such interpretation raises questions regarding the limits of judicial activity in shaping admissibility requirements in criminal matters, particularly in single-instance proceedings.

Resumo O trabalho analisa a influência da mídia nas decisões dos jurados no Tribunal do Júri. O estudo busca entender se: a exposição prévia a notícias sobre o acusado, influencia o julgamento dos jurados quanto à culpa e à fixação da pena? No caso, a pesquisa demonstrou que, se tratando de condenação ou absolvição o acesso anterior a informações sobre o acusado não teve influência significativa. Porém, quando os estudantes decidiram a pena a ser aplicada, o grupo com exposição prévia votou em sua maioria em penas maiores. Para a produção dos dados, 313 estudantes da Universidade Tuiuti do Paraná, participaram de um júri simulado sobre um caso de homicídio simples, apresentado em vídeo, produzido pelos pesquisadores com o uso de inteligência artificial. Os participantes puderam absolver o acusado ou condená-lo à pena mínima ou máxima, e foram divididos em dois grupos, o primeiro que somente assistiu ao vídeo do julgamento e outro grupo que, antes do vídeo foi apresentado a uma notícia, também criada pelos pesquisadores e que continha informações pejorativas sobre o acusado. Após ambas as apresentações os estudantes responderam um questionário, no qual puderam, de forma anônima, dar o seu o veredito sobre o caso.

Abstract in English:

Abstract The study analyzes the influence of the media on jurors’ decisions in the Jury Trial Court. It seeks to understand whether prior access to news about the defendant influences jurors’ judgments regarding guilt and the determination of the sentence. In this regard, the research demonstrated that, with respect to conviction or acquittal, prior access to information about the defendant did not have a significant influence. However, when the students decided on the sentence to be imposed, the group with prior exposure voted predominantly for harsher penalties. For data collection, 313 students from Universidade Tuiuti do Paraná participated in a simulated jury trial involving a case of simple homicide, presented in video format and produced by the researchers using artificial intelligence. The participants could acquit the defendant or convict him to either the minimum or maximum sentence. They were divided into two groups: the first group only watched the trial video, while the second group was presented with a news report—also created by the researchers and containing pejorative information about the defendant—before watching the video. After both presentations, the students answered a questionnaire in which they were able to anonymously deliver their verdict on the case.

Resumo O presente artigo tem por objetivo analisar os resultados de pesquisa empírica realizada com policiais civis do estado de São Paulo que atuam na Delegacia de Defesa da Mulher On-line, com foco no atendimento às potenciais vítimas de violência doméstica na fase extrajudicial da persecução penal. Assim, a questão central que se coloca é: como protocolos de entrevista, como o modelo PEACE, são aplicados e em que medida colaboram para a recuperação de informações armazenadas na memória dessas mesmas vítimas? A justificativa decorre da importância dessa unidade como modelo pioneiro de atendimento virtual e das gravações dos relatos prestados em suas dependências. A hipótese é que o uso adequado de técnicas de entrevista pode qualificar a investigação preliminar e refletir positivamente nessa etapa da persecução penal, a partir de contribuições, especialmente, da epistemologia jurídica e da psicologia do testemunho, assim como da perspectiva de gênero, com o finalístico intuito de resguardar o acesso à justiça. A metodologia envolveu aplicação de questionários e análise qualitativa das respostas. Os resultados revelam como os protocolos são empregados e observados por policiais, permitindo avaliar o grau de aderência às diretrizes recomendadas e os desafios enfrentados na prática. O estudo destaca a etapa extrajudicial como fundamental para a produção de provas fiáveis, sobretudo quando baseadas na memória.

Abstract This article aims to analyze the results of empirical research conducted with civil police officers in the state of São Paulo who work at the Online Women’s Defense Police Station, focusing on assisting potential victims of domestic violence in the extrajudicial phase of criminal prosecution. Thus, the central question is: how are interview protocols such as the PEACE model applied and to what extent do they contribute to the recovery of information stored in the memory of these victims? The justification stems from the importance of this unit as a pioneering model of virtual assistance and from the recordings of the reports provided on its premises. The hypothesis is that the proper use of interview techniques can improve the preliminary investigation and have a positive impact on this stage of criminal prosecution, based on contributions from legal epistemology, psychology of testimony, as well as from a gender perspective, with the ultimate goal of safeguarding access to justice. The methodology involved the application of questionnaires and qualitative analysis of the responses. The results reveal how the protocols are employed and observed by police officers, allowing for an assessment of the degree of adherence to the recommended guidelines and the challenges faced in practice. The study highlights the extrajudicial stage as fundamental for the production of reliable evidence, especially when based on memory.

Testimonial Epistemic Injustice against family members of victims of police lethality in criminal legal system Pinheiro, Luciano Santana

Resumo Este artigo tem por objetivo descrever e caracterizar a previsão legal e o modo de participação de familiares de vítimas da letalidade policial em processos de responsabilização criminal decorrentes de abordagens policiais com resultado morte. O estudo destaca a centralidade da biografia da vítima na persecução penal, bem como a existência de um conjunto de normas fragmentadas e com diferentes graus de força normativa. Para a construção do corpus empírico do trabalho, mobilizamos o estudo de caso a partir de dois episódios de morte decorrente de intervenção policial. A pesquisa combinou análise processual, entrevistas semiestruturadas e observação participante de um tribunal do Júri, de modo a reconstituir a biografia institucional dos familiares-vítima ao longo do sistema de justiça criminal. A análise do material empírico, à luz dos trabalhos de Miranda Fricker, Jennifer Lackey e outros críticos, permite afirmar que a participação dos familiares das vítimas no sistema de justiça criminal é marcada por uma injustiça epistêmica, manifestada em três modalidades: a descredibilização da vítima e de seus familiares, o excesso de credibilidade atribuído à versão apresentada pelos policiais e injustiça epistêmica agencial, o que configura uma injustiça epistêmica testemunhal. Essas modalidades impactam diretamente a forma como os familiares participam dos processos de responsabilização dos policiais, tornando-os, vítimas pela segunda vez.

Abstract This article examines the legal framework and modes of participation of family members of victims of police killings in criminal accountability proceedings arising from police interventions resulting in death. It highlights the central role of the victim’s biography in prosecutions, as well as the fragmented and hierarchically uneven set of legal norms that regulate such cases. Based on two case studies of deaths resulting from police intervention, the research combines procedural analysis, semi-structured interviews, and participant observation in a jury court, in order to reconstruct the institutional biography of victim-families throughout their trajectory within the criminal justice system. Drawing on the work of Miranda Fricker, Jennifer Lackey, and other critical theorists, the study argues that the participation of victims’ families is shaped by epistemic injustice in three main forms: the discrediting of the victims and their relatives, the excessive credibility granted to police narratives, and the restriction of their epistemic agency — all of which constitute a form of testimonial epistemic injustice. These dynamics directly affect how families engage in the processes of police accountability, ultimately victimizing them a second time.

Custody hearings and proposals for restriction: an empirical analysis based on data from Araraquara/SP Bergo, Augusto Fargoni Nascimento Júnior, Jamil Gonçalves do Pião Neto, Pedro Simões

Resumo O Projeto de Lei n. 1.286/2022 propõe restringir a realização de audiências de custódia a reincidentes e indivíduos com maus antecedentes sob quatro justificativas: (1) as audiências de custódia têm se revelado patente mecanismo de desrespeito aos agentes da lei e de proteção indevida de criminosos na medida em que coloca em dúvida a atuação da força policial; (2) a audiência de custódia fragiliza a credibilidade de todo o sistema de justiça criminal, dando lugar à sensação de impunidade; (3) independente da audiência de custódia o juiz terá condições de saber se o caso permite que se apliquem as medidas cautelares diversas da prisão; (4) grande parte dos presos levados a essas audiências de custódia são reincidentes. No entanto, como as justificativas não apresentam respaldo científico, o presente trabalho pretende responder as seguintes questões: É possível identificar um número significativo de reincidentes? A audiência de custódia “coloca em dúvida a atuação policial” e “fragiliza o sistema de justiça”? As formalidades legais são devidamente respeitadas? Para responder esses questionamentos, os autores levantaram dados sobre a audiência de custódia, no período de 06 (seis) meses, no Município de Araraquara/SP, somente nos casos de prisão em flagrante por crime cometido no âmbito da violência doméstica. A escolha dessa cidade deve-se ao fato de todos os casos dessa natureza serem registrados em uma única delegacia. A opção por investigar crimes no âmbito da violência doméstica se justifica pelo aumento dos registros desse tipo de delito. Além disso, também houve o levantamento de estudos que se debruçaram sobre a matéria. Ao final, os autores apresentaram o resultado dos dados levantados e os confrontaram com os resultados de outros estudos sobre a mesma matéria. Com isso, a conclusão é a de que as justificativas apresentadas pelo Projeto de Lei n. 1.286/2022 não são suficientes para sustentar a restrição da audiência de custódia.

Abstract Bill No. 1,286/2022 proposes to restrict the holding of custody hearings to repeat offenders and individuals with prior criminal records, based on four main justifications: (1) the claim that custody hearings have become an overt mechanism of disrespect toward law enforcement officers and of undue protection of offenders, insofar as they call into question police conduct; (2) the argument that custody hearings undermine the credibility of the criminal justice system as a whole, fostering a sense of impunity; (3) the assertion that, regardless of the custody hearing, judges are able to determine whether the case allows for the application of non-custodial precautionary measures; and (4) the contention that a large proportion of detainees brought before custody hearings are repeat offenders. However, given the absence of any scientific evidence supporting these justifications, this study seeks to address the following questions: is it possible to identify a significant proportion of repeat offenders? Do custody hearings “call into question police conduct” and “undermine the criminal justice system”? Are legal formalities duly observed? To answer these questions, the authors collected data on custody hearings conducted over a six-month period in the municipality of Araraquara, in the state of São Paulo, focusing exclusively on cases of in flagrante arrest for crimes committed in the context of domestic violence. The choice of this municipality is justified by the fact that all cases of this nature are recorded at a single police station. The decision to examine domestic violence cases is further justified by the increase in reported incidents of this type of offense. In addition, the study includes a review of empirical research addressing the same subject matter. Finally, the authors present the results of the collected data and compare them with the findings of the reviewed studies. On this basis, the study concludes that the justifications put forward by Bill No. 1,286/2022 are insufficient to support the proposed restriction of custody hearings.

Plea Agreements in War Crimes Cases: A Critical Analysis of Negotiated Justice in Bosnia and Herzegovina’s Transitional Context Kazić-Çakar, Ena

Resumo Tendo em vista a totalidade das transformações dos regimes estatais nos últimos quarenta anos e dos conflitos que se tornaram passados e duradouros, sem dúvida, a justiça de transição tem e terá um papel essencial nos sistemas jurídicos dos países de todo o mundo. Estabelecer a verdade e a reconciliação são tarefas essenciais. Este artigo correlaciona a justiça de transição com o instituto processual da justiça criminal do “acordo sobre a sentença” e testa como esse instituto, como um dos seus mecanismos, pode se tornar um obstáculo para alcançar os seus objetivos. Realiza-se um estudo de caso da sua aplicação nos casos de crimes de guerra na Bósnia e Herzegovina para testar se e como os acordos sobre a sentença foram aplicados nos casos das infrações penais mais graves e se a sua aplicação pode alcançar os objetivos do direito penal, por um lado, e da justiça transicional, por outro. Como método científico, o artigo se utiliza dos métodos normativo, histórico e comparativo, além de estudo de caso.

Abstract Considering all the transformations of state regimes in the last forty years and all the conflicts that became past and lasting ones, without any doubt, transitional justice has and will have an essential role in the legal systems of the countries of the world. Establishing the truth and reconciliation are critical tasks. This article correlates transitional justice to the criminal justice procedural institute of “plea agreement” and tests how this institute within one of its mechanisms may become an obstacle in achieving its goals. A case study of its application in the cases of war crimes in Bosnia and Herzegovina will be conducted to test if and how plea agreements have been applied in the cases of those gravest criminal offenses and if its application may achieve the goals of criminal law in one hand, and transitional justice on other. Normative, historical, and comparative scientific methods, in addition to the case study, will be used.
