The notion of defeasibility for Herbert L. A. Hart

Abstract

This article investigates the defeasibility concept to Herbert L. A. Hart, who has been identified as the responsible to introducing this notion to the field of Philosophy of Law. Research examines Hart’s arguments and their relevance to the current debate on the adequacy of general legal rules to particular cases from the rule/ exception relationship.
