Marx and the juridical form in The Capital: a dialogue with Pachukanis

Abstract

We will deal here with the Marxian approach to a juridical form. Contrary to a Pachukanian thesis about a relationship between juridical and mercantile form, we will try to demonstrate that the author of The Capital gives a different meaning to the concept. First, it should be noted that it usually does not appear as a “juridical form” but in the plural. Subsequently, it is possible to see that the concept refers much more to several figures that are real and effective in capitalist society than to a form analogous to the equivalence present in the exchange of commodities. There is a relationship between interest, rent and juridical forms, treated at book III.
