Freedom to learn and teach reflections based on Interamerican Human Rights System

Abstract

This article proposes to think about Latin American legal foundations for the freedom to learn and teach in the contemporary context of prohibitions of content or methodologies labeled as political-ideological indoctrination or implementation of what became known as “gender ideology”. Based on the proposal of a Latin American Ius Constitutionale Commune, some judgments and advisory opinions relevant to the topic of the Inter-American Court of Human Rights, the Constitutional Court of Colombia and the Federal Supreme Court of Brazil are analyzed in order to articulate interpretative parameters on freedom of expression, protection of childhood, right to equality and education in an attempt to demonstrate the freedom to learn and teach in basic education as a protected category in inter-American law.
