The fall of Executive Power in Indonesia: the need to strengthen legal arrangements AYUNI, QURRATA ARSIL, FITRA ALATAS, ALWI

Resumo: Este artigo discute conclusões interessantes relacionadas com o enfraquecimento do Poder Executivo na Indonésia durante o médio prazo. A principal conclusão é que o executivo tende a optar pela demissão em vez de enfrentar um impeachment ou um voto institucional de desconfiança. Além disso, a história da Indonésia regista que as crises constitucionais também levaram a mudanças na estrutura do Estado e do governo. As deficiências nos acordos legais contribuíram para o papel pouco claro do impeachment e das moções de censura na manutenção da legitimidade do governo. Através de uma abordagem histórica e comparativa, este artigo afirma que a maioria das quedas do poder executivo na Indonésia foram causadas por outras causas que não a queda constitucional oficial dos procedimentos governamentais.

Abstract: This paper discusses interesting findings related to the weakening of executive power in Indonesia during the mid-term. The main finding is that the executive tends to choose to resign rather than face impeachment or an institutional vote of no confidence. In addition, Indonesian history records that constitutional crises have also led to changes in the structure of the state and government. Weaknesses in legal arrangements have contributed to the unclear role of impeachment and no-confidence motions in maintaining government legitimacy. Through a historical and comparative approach, this article asserts that the majority of executive power falls in Indonesia have been caused by causes other than the official constitutional fall of government procedures.

¿Y ahora qué? Forma es fondo: el laboratorio constitucional y el proceso constituyente en Chile PARMO, DOMINGO ANDRÉS LOVERA

Resumen: Chile acaba de concluir dos procesos constituyentes. El primero, se desarrolló entre 2019 y 2022 - y cuya extensión se debe a la crisis sanitaria por la pandemia -, terminó con el rechazo de la propuesta por un 62% de la ciudadanía. El segundo, que se desarrolló durante 2023, terminó con el rechazo de la propuesta por un 56% de la ciudadanía. De esta manera, Chile se presenta como el primer país del mundo en que dos procesos constituyentes consecutivos terminan sin éxito. En palabras de varios actores y comentaristas políticos, esto representa un fracaso al no haberse podido reemplazar la Constitución de 1980 - y por cuyo reemplazo un abrumador 78% votó a favor en 2020 -. Este artículo - en línea con alguna literatura nacional que se aborda en este trabajo -, argumenta que, dada la particularidad del modelo constitucional legado por la dictadura, el fracaso de los procesos constituyentes debe evaluarse no a la luz de la sustancia o contenido de las propuestas rechazadas, en cuyo caso es innegable que no lograron el reemplazo, sino que a la luz del impacto que esos procesos tuvieron en la modificación de los cerrojos procedimentales que protegían la obra constitucional de la dictadura.

Abstract: Chile has just concluded two constituent processes. The first one, which took place between 2019 and 2022 - and whose extension was due to the health crisis caused by the pandemic -, ended with the rejection of the proposal by 62% of the citizens. The second, which took place during 2023, ended with the rejection of the proposal by 56% of the citizens. With this, Chile becomes the first country in the world in which two consecutive constituent processes end unsuccessfully. In the words of several commentators and political actors, this represents a failure to replace the 1980 Constitution - for whose replacement an overwhelming 78% voted in favor in 2020 -. This article - in line with some of the literature discussed in this paper - argues that, given the particularity of the constitutional model imposed by the dictatorship, the failure of the constituent processes should be evaluated not in light of the substance or content of the rejected proposals, in which case it is undeniable that they did not achieve their goal, but rather in light of the impact that these processes had in modifying the procedural locks that protected the constitutional oeuvre of the dictatorship.

Principio de deferencia al órgano legislativo y derechos humanos CAVALLO, GONZALO AGUILAR ROYO, DANIELA MENDEZ

Resumen: Con la aparición de la justicia constitucional, surge un principio llamado deferencia al órgano legislativo. El principio de deferencia trae consigo la idea de la restricción de la labor de los tribunales en el análisis de la constitucionalidad de las normas. En este trabajo se analizará el concepto origen y fundamentos de este principio, además de plantearse que debe ser atenuado cuando en el análisis, colisiona con los derechos humanos, dándoles primacía incluso por sobre decisiones democráticas.

Abstract: With the appearance of constitutional justice, a principle called deference to the legislative organ. The principle of deference brings with it the idea of restricting the work of the courts in the analysis of the constitutionality of the norms. In this work, the origin concept and foundations of this principle will be analyzed, in addition to considering that it should be attenuated when, in the analysis, it collides with human rights, giving them primacy even over democratic decisions.

El aborto como derecho fundamental en Colombia: un análisis desde la (in)seguridad jurídica constitucional PATIÑO, LUISA MAYA-GARCÍA, VERÓNICA MENDIETA, DAVID

Resumen en Español:

Resumen: En los últimos tres años se han dado avances y retrocesos frente al reconocimiento del derecho al aborto en países como México, Brasil, Argentina, Chile, Colombia y EE. UU. Este artículo busca dejar constancia de lo anterior y tomar como referente el caso colombiano, pues en una decisión histórica del año 2022 (con 5 magistrados a favor y 4 en contra), la Corte Constitucional del país andino despenalizó la interrupción voluntaria del embarazo hasta la semana veinticuatro y conservó las tres causales tradicionales para embarazos que superen este plazo. Con el uso de una metodología analítico-descriptiva se pudo demostrar que, al interior de la máxima autoridad de constitucionalidad colombiana, aún hay un sector que no reconoce el IVE como un derecho, lo que ha llevado a la Corte en pleno a tener que declarar la nulidad de dos sentencias de tutela proferidas por magistrados del mismo tribunal. Lo anterior denota inseguridad jurídica, donde las más afectadas son las mujeres a las que se les negó este derecho.

Abstract: In the last three years, there have been advances and setbacks in the recognition of the right to abortion in countries such as Mexico, Brazil, Argentina, Chile, Colombia and the U.S. This article seeks to record the above and take the Colombian case as a reference, since in a historic decision in 2022 (with 5 judges in favor and 4 against), the Constitutional Court of the Andean country decriminalized the voluntary termination of pregnancy up to twenty-four weeks and retained the three traditional grounds for pregnancies beyond this period. With the use of an analytical-descriptive methodology, it was possible to demonstrate that, within the highest Colombian constitutional authority, there is still a sector that does not recognize abortion as a right, which has led the full Court to declare null and void two tutelage sentences rulings issued by magistrates of the same court. This denotes legal insecurity, where the most affected are the women who were denied this right.

Pensando los “nuevos derechos” en clave temporal: hacia un test de autenticidad de derechos humanos Díez Spelz, Juan Francisco

Resumen en Español:

Resumen Los “nuevos derechos” son un fenómeno de nuestra época, que responde al carácter evolutivo de los derechos humanos. Esta dinamicidad propia de los derechos humanos se observa, ya sea en el ámbito de la expansión normativa o en el de la interpretación. Procuran, así, responder a nuevas necesidades, intereses o circunstancias. Sin embargo, son también un fenómeno problemático que puede llevar a su proliferación artificial. Para ello, este artículo reflexiona en torno a las implicaciones jurídicas de concebir “nuevos derechos” y propone un test de autenticidad basado en la idea de tiempo, con el fin de abonar en la mejor comprensión de los auténticos derechos humanos.

Abstract The “new rights” are a phenomenon of our time, which responds to the evolutionary nature of human rights. This dynamic nature of human rights is observed, whether in the area of ​​normative expansion or in that of interpretation. They thus try to respond to new needs, interests or circumstances. However, they are also a problematic phenomenon that can lead to their artificial proliferation. To this end, this article reflects on the legal implications of conceiving “new rights” and proposes an authenticity test based on the idea of ​​time, in order to contribute to a better understanding of authentic human rights.

Judicialization of Health Rights in Colombia and Brazil: A Comparative Analysis of Courts' Approaches to Experimental, Excluded and Included Medicaments and Technologies Gutiérrez Silva, Rodolfo

Resumo A judicialização dos direitos à saúde na Colômbia e no Brasil influenciou significativamente as políticas de saúde e a alocação de recursos. Este artigo compara a judicialização dos direitos à saúde nesses países, focando nas abordagens dos tribunais em relação a medicamentos e tecnologias experimentais, excluídos e incluídos. Utilizando uma metodologia qualitativa e comparativa, o estudo revisa literatura e jurisprudência para examinar marcos legais, precedentes judiciais e evidências empíricas. A análise aborda quatro áreas: o contexto geral da judicialização, considerações dos tribunais sobre tecnologias experimentais, serviços e medicamentos não incluídos no plano básico de saúde, e aqueles incluídos no plano. Na Colômbia, os tribunais seguem um modelo de "lista negativa", garantindo acesso à maioria dos serviços de saúde, a menos que explicitamente excluídos. Os tribunais brasileiros, guiados por mandatos constitucionais, frequentemente favorecem o acesso dos pacientes, baseando-se em avaliações técnicas de instituições públicas de saúde. O estudo conclui que a judicialização avançou os direitos à saúde, mas também apresentou desafios à sustentabilidade do sistema de saúde, à equidade e ao equilíbrio entre direitos individuais e saúde pública. Abordar esses desafios requer o fortalecimento dos processos de avaliação de tecnologias em saúde, o fomento ao diálogo interinstitucional e a implementação de reformas sistêmicas para garantir acesso equitativo. Além disso, reformas judiciais internas e reformas externas do sistema de saúde e políticas são essenciais para um sistema mais sustentável e equitativo, enfatizando o diálogo interdisciplinar, a transparência de dados e a clareza nas premissas normativas e políticas.

Resumen en Inglés:

Abstract The judicialization of health rights in Colombia and Brazil has significantly influenced health policies and resource allocation. This article compares the judicialization of health rights in these countries, focusing on courts' approaches to experimental, excluded, and included medicaments and technologies. Using a qualitative and comparative methodology, the study reviews literature and jurisprudence to examine legal frameworks, judicial precedents, and empirical evidence. The analysis addresses four areas: the general context of judicialization, court considerations for experimental technologies, services and medicaments not included in the basic health plan, and those included. In Colombia, courts follow a "negative list" framework, granting access to most health services unless explicitly excluded. Brazilian courts, guided by constitutional mandates, often favor patient access, relying on public health institutions' technical assessments. The study concludes that judicialization has advanced health rights but also posed challenges to health system sustainability, equity, and balancing individual rights with public health. Addressing these challenges requires strengthening health technology assessment processes, fostering inter-institutional dialogue, and implementing systemic reforms for equitable access. Additionally, internal judicial reforms and external health system and policy reforms are essential for a sustainable and equitable system, emphasizing interdisciplinary dialogue, data transparency, and clarity in normative and political premises.

Direitos LGBTQIA+ e reação neoconservadora: análise jurídica antidiscriminatória das propostas legislativas de “cura gay” Rios, Roger Raupp

Resumo Tomando as disputas sociais e políticas em torno da propalada “cura gay” no cenário brasileiro contemporâneo, examinam-se as respectivas iniciativas parlamentares instituidoras de tratamentos discriminatórios. As razões que pretendem justificá-las são analisadas, particularmente (1) a utilização de conceitos superados e a imputação de disfunções sexuais às práticas homoeróticas; (2) a consideração de privilégios para homossexuais em detrimento de heterossexuais, ao passo que se objetiva enfrentar desvantagens e estigmas; (3) a incompreensão da livre orientação sexual como direito fundamental; (4) a desqualificação da competência normativa do CFP em matéria de ética profissional; (5) a alegação de violação das liberdades de expressão e de ciência, desconsiderando a proibição do discurso de ódio e a histórica instrumentalização por que passou o discurso científico; (6) a acusação de preconceito contra os adeptos das terapias de reversão sexual, mediante a deturpação do conceito jurídico de discriminação, uma vez que a heterossexualidade, em si mesma, não é historicamente fator desencadeador de discriminação e (7) a sustentação de que a “cura gay” objetiva atender a sexualidades egodistônicas, como se tal diagnóstico não implicasse a manutenção da patologização da homossexualidade.

Abstract Taking into account the social and political disputes surrounding the so-called “gay cure” in the contemporary Brazilian scenario, this paper examines the respective parliamentary initiatives, which establish discriminatory treatments. It analyzes their reasons, particularly (1) the use of outdated concepts and the attribution of sexual dysfunctions to homoerotic practices; (2) the consideration of privileges for homosexuals to the detriment of heterosexuals, while aiming to confront disadvantages and stigmas; (3) the misunderstanding of free sexual orientation as a fundamental right; (4) the disqualification of the CFP's normative competence in matters of professional ethics; (5) the allegation of violation of freedoms of expression and science, disregarding the prohibition of hate speech and the historical instrumentalization that scientific discourse has undergone; (6) the accusation of prejudice against supporters of sexual reversion therapies, through the distortion of the legal concept of discrimination, since heterosexuality, in itself, is not historically a triggering factor for discrimination and (7) the claim that the “gay cure” aims to address egodystonic sexualities, as if such a diagnosis did not imply itself the maintenance of the pathologization of homosexuality.

The principle of proportionality under democratic scrutiny: towards a comprehensive method for the analysis of human rights restrictions Garat, María Paula

Resumo: O presente artigo tem por objetivo responder à seguinte indagação: de que forma a democracia é - e deve ser - considerada na análise das limitações impostas aos direitos fundamentais. O estudo se fundamenta na jurisprudência da Corte Interamericana de Direitos Humanos (Corte IDH) e da Corte Europeia de Direitos Humanos (CEDH), considerando, por conseguinte, a Convenção Americana sobre Direitos Humanos (CADH) e a Convenção Europeia de Direitos Humanos (CEDH). Em especial, o trabalho concentra-se na interpretação da cláusula “necessária em uma sociedade democrática”, exigência prevista em ambos os tratados internacionais. Propõe-se, nesse contexto, a introdução de uma etapa preliminar à aplicação do teste de proporcionalidade na análise das restrições a direitos humanos. Essa etapa é construída sobre bases teóricas consistentes, considerando críticas já formuladas ao exame de proporcionalidade e apoiando-se em teorias jurídicas que conferem centralidade à coerência dos sistemas normativos. Ademais, a pesquisa busca demonstrar a necessidade dessa fase introdutória a partir da vinculação entre a efetividade dos direitos e a aplicação consistente e coerente dos tratados internacionais de direitos humanos em vigor.

Resumen en Inglés:

Abstract: This paper aims to answer the question of how democracy is and should be considered in the analysis of limitations on fundamental rights. The case law is based on the I/A Court HR and ECtHR decisions, consequently considering the ACHR and the ECHR. In particular, the paper focuses on the interpretation of the "necessary in a democratic society" clause, a requirement stated in both the ECHR and the ACHR. It proposes to add a first step to the analysis of human rights limitations prior to the proportionality test. The paper builds this step on solid theoretical foundations, in attendance of some of the critics of the proportionality exam and based on theories that put coherence in legal systems at the centre. Furthermore, the research aims to demonstrate the need for this stage through the connection between the effectiveness of rights and the consistent and coherent application of the current human rights treaties.
