Open-access “And he gave him forgiveness for his mistakes and assured him of peace ”: jurisdiction over the ius pacis and peace treaties in the Northern captaincies (1670-1720)

This paper analyzes the jurisdiction that the rulers of State of Brazil, notably the governors and captain-majors, had over matters of peace and war. It will examine some of the conceptions of the time regarding jurisdiction over war and peace and how this power was delegated to overseas rulers. The analysis will focus on the concessions, agreements and peace treaties signed by the captains-major of Ceará and Rio Grande and the governors of Pernambuco, between 1670 and 1720. The aim is to understand the legal foundations that authorized these rulers to grant peace treaties.
