1) Parecer Cremesp 29.299/1996 13 – Transfusão de sangue em testemunha de Jeová
Consulta: Os doutores VDVF e PJF solicitam parecer do Cremesp referente às seguintes indagações: 1) Se há impedimento para a transfusão de hemoderivados em paciente “Testemunha de Jeová”?; 2) Qual a responsabilidade do médico assistente e do médico hemoterapeuta no caso em pauta quanto à administração da transfusão como único método de tratamento emergencial da anemia do paciente no caso apresentado?
Ementa: é inegável, e cada vez melhor aceito pelo direito brasileiro, o direito de quem quer que seja de decidir sobre si mesmo, significando que a pessoa não pode se constrangida a aceitar qualquer conduta terapêutica, ainda que, na visão de terceiros, essa conduta vá beneficiá-la.
2) Parecer Cremesp 37.267/1999 14 – Distanásia
Consulta: Atitude que deve tomar como médica acerca de paciente de 78 anos com neoplasia maligna metastática sem resposta ao tratamento habitual, após autorização verbal dos familiares para não intubar, em franca evolução para insuficiência respiratória.
Ementa: A situação descrita pela consulente se enquadra claramente nos casos em que o médico intervindo sobre o paciente, no mais das vezes à revelia ou até contra a vontade dele e de seus familiares, passa a assumir mais a postura de torturador do que de médico.
3) Parecer Cremesp 105.715/2004 15 – Autonomia do paciente
Consulta: A Dra. SBS., na qualidade de médica responsável técnica de serviço de nefrologia e diálise, solicita parecer acerca das providências possíveis, diante da manifestação de um paciente preso, dando conta de sua insatisfação com o tratamento oferecido, bem como solicitando transferência do respectivo serviço médico. Após breve exposição dos fatos, onde consta inclusive recusa de internação por parte do paciente e má adesão ao tratamento, a consulente questiona este Cremesp acerca da posição que deve adotar.
Ementa: Paciente preso que recusa tratamento de diálise oferecido, requerendo transferência de serviço. Má-adesão ao tratamento. Recusa de internação. Direito de escolha deve ser observado.
4) Parecer Cremesp 82.406/04 16 – Sigilo profissional
Consulta: Se é permitida a utilização de tarjas coloridas na capa dos prontuários médicos, conforme a patologia do paciente, com o intuito de facilitar a localização dos prontuários; e se a Comissão de Revisão de Prontuários tem o poder de interferir nesta situação ou é apenas um órgão consultivo.
Ementa: O sigilo profissional e a preservação da privacidade dos pacientes são os pilares que sustentam esta singularíssima relação profissional de médico-paciente. Assim, nos parece absolutamente inadequado, sob todos os pontos de vista, o uso de “tarjas coloridas” para identificar paciente com determinado diagnóstico.
5) Parecer Cremesp 84.368/2007 17 – Limitação de procedimentos de doenças em fase final
Consulta: Mãe de paciente menor, através de pedido expresso, informar que é contra qualquer tipo de reanimação, por parte da equipe médica, em sua filha, caso haja alguma intercorrência. A criança apresenta agravo neurológico irreversível relacionado a doença de base com possibilidade de dependência de ventilação pulmonar mecânica.
Ementa: Como consta da consulta, de fato, a adoção de medidas de limitação de procedimentos e tratamentos que prolonguem a vida de doente em fase terminal, de enfermidade grave e incurável respeitada a vontade da pessoa ou de seu representante legal, “tem todo o amparo ético, moral e legal no Brasil”.
6) Parecer Cremesp 90.198/2010 18 – Comunicação de morte aos familiares
Consulta: Acerca de comunicação ao paciente de um diagnóstico recém-concluído ou mesmo o caso de óbito, é de responsabilidade de qual profissional: o médico, o psicólogo ou enfermeiro?
Ementa: Entendemos que explicar determinado resultado de exame, informar o diagnóstico e o prognóstico, esclarecer e tirar todas as dúvidas do paciente ou de familiar são ações de competência do médico, coordenador da equipe de saúde, e maior responsável pela qualidade de atenção ao agravo do paciente. Particularmente em relação à informação aos familiares da morte de um determinado paciente nos parece fundamental que seja dada pelo principal responsável pela equipe de saúde, o médico; exceto naqueles casos, por algum motivo particular, que outro profissional possa desempenhar de forma mais adequada, do ponto de vista profissional, essa custosa função. Essas exceções sempre levarão em conta a melhor conduta para aquela determinada situação.
7) Parecer Cremesp 124.460/2010 19 – Termo de consentimento livre e esclarecido na prática clínica
Consulta: Se o diretor clínico pode tornar obrigatório o preenchimento do formulário sobre consentimento informado aos profissionais médicos da instituição.
Ementa: Obrigatoriamente devem constar no prontuário médico os esclarecimentos prestados e o consentimento do paciente. Não achamos razoável nem necessário obter a assinatura do paciente para todo e qualquer procedimento médico. Por outro lado, nada impede que o TCLE seja utilizado em determinados serviços ou departamentos médicos para a realização de exames diagnósticos invasivos, cirurgias e terapêuticas mais agressivas. Não é possível que um diretor clínico baixe norma obrigando o TCLE para todos os procedimentos ou para determinados procedimentos.
8) Parecer Cremesp 155.608/2011 20 – Conduta médica perante abandono de seguimento pós-operatório pelo paciente
Consulta: Sobre como atestar, de maneira legal e ética, o abandono de tratamento por parte do paciente.
Ementa: Cumprindo todos os deveres elencados, além de manter um relacionamento respeitoso e educado com seus pacientes, o médico dificilmente será vítima de qualquer manobra aética por parte de seu paciente. Se mesmo agindo corretamente o médico for vítima de manobra aética e imoral por parte de seu paciente, nossos tribunais, em pleno estado de direito, certamente punirão os culpados nas inevitáveis lides éticas e judiciais a que todos que exercemos a arte hipocrática estamos sujeitos.
9) Parecer Cremesp 138.679/2011 21 – Sigilo do prontuário médico
Consulta: Família frequentemente questiona o tratamento dispensado à paciente internada com quadro grave de saúde. Equipe médica deseja orientação quanto ao seguimento do caso, e se a paciente a falecer, o médico assistente do momento deverá assinar o atestado de óbito ou encaminhá-la para o Serviço de Verificação de Óbito (SVO).
Ementa: O médico assistente, responsável pela paciente e líder da equipe multiprofissional, deve ser o responsável por relacionar-se com a paciente, buscando sempre o melhor interesse dela. Tem o compromisso e o dever de vigilância, de informação e de obter o consentimento para todos os atos praticados. A família pode e deve ser informada, mas o compromisso primeiro do médico e da equipe é com a paciente, inclusive na proteção de sua privacidade. A família deve ser informada do referencial bioético do sigilo a que a paciente tem direito e que a família poderá ter restrição de acesso ao prontuário, se assim for vontade da paciente. Se autorizado pela paciente, esse acesso deve ser liberado aos familiares. Se a paciente, por qualquer motivo, perder totalmente ou parcialmente sua autonomia, e o médico assistente a considerar incapaz de tomar decisões autônomas, deve verificar quem possa representá-la junto à equipe e informar e discutir as propostas terapêuticas com essa pessoa.
10) Parecer Cremesp 18.688/2012 22 – Testamento vital
Consulta: Sobre a desobrigação dos médicos em prolongar a vida de pacientes terminais.
Ementa: Reconhecendo que o paciente tem direito a morte digna, escolhendo como e onde morrer, recusar ou solicitar certos tratamentos, medicamentos e intervenções, bem assim interrompê-los, é juridicamente possível dispor em documento visando assegurar a garantia constitucional de sua liberdade, inclusive de consciência. Mas não há no ordenamento jurídico pátrio nenhum modelo, fórmula ou previsão legal expressa dos contornos a orientá-lo, porém também não há em sentido contrário, impedindo sua confecção à míngua da previsão de traços que deverá observar. Mas fundamentalmente, mais do que um documento com apelo à formalidade, deverá ser o resultado de um processo envolvendo paciente, familiares, médicos assistentes, a fé religiosa, construído com a conscientização de todos acerca de nossa vontade e nossos desejos, com respeito às individualidades, e amadurecido com a compreensão de nossa finitude.

1) Cremesp Opinion 29.299/1996 13 – Blood transfusion in Jehovah’s Witness
Consultation: Doctors VDVF and PJF requested the opinion of Cremesp in relation to the following questions: 1) Is there any obstacle to the transfusion of blood products in a Jehovah’s Witness patient?; 2) What is the responsibility of the attending doctor and the hemotherapy physician when the administration of a transfusion is the only method of emergency treatment of the anemia of the patient in the presented case?
Opinion: it is undeniable, and increasingly accepted by Brazilian law, the right of the individual to decide for themselves, meaning that a person cannot be constrained to accept any therapeutic conduct, even if, in the view of third parties, this conduct will be of benefit
2) Cremesp Opinion 37.267/1999 14 – Dysthanasia
Consultation: The approach a doctor should take in the case of a 78-year-old patient with metastatic malignant neoplasm who did not respond to the usual treatment, following verbal authorization of relatives not to intubate, in a clear course of respiratory failure.
Opinion: The situation described by the consultant clearly fits with cases in which the doctor, intervening in the case of the patient, more often than not in the absence of or even against his will and that of his family, begins to assume a posture more of torturer than of doctor.
3) Cremesp Opinion 105.715/2004 15 – Patient autonomy
Consultation: Doctor SBS., in her capacity as the medical technician responsible for the nephrology and dialysis service, requests an opinion on the possible measures to be taken, in response to the manifestation of a prisoner, reporting his dissatisfaction with the treatment offered, as well as requesting the transfer of the respective medical service. After a brief presentation of the facts, including the refusal of hospitalization by the patient and poor adherence to treatment, the querent questions Cremesp about the position that should be adopted.
Opinion: a prison inmate patient who refuses the dialysis treatment offered, requiring the transfer of service. Poor adherence to treatment. Refusal of hospitalization. Right of choice must be observed.
4) Cremesp Opinion 82.406/04 16 – Professional confidentiality
Consultation: If it is permissible to use colored stickers on the cover of medical records, based on the pathology of the patient, in order to facilitate the localization of such records; and if the Medical Record Review Commission has the authority to interfere in this situation or if it is merely a consultative organ.
Opinion: professional confidentiality and the preservation of patient privacy are the pillars that support the unique doctor-patient professional relationship. Thus, it seems to us absolutely inappropriate, from any perspective, to use ‘colored stickers’ to identify patients with a certain diagnosis.
5) Cremesp Opinion 84.368/2007 17 – Limiting of procedures to treat diseases in final phase
Consultation: the mother of a child patient, through an express request, states that she is against any type of resuscitation of her daughter by the medical team, in the case of complications. The child suffers irreversible neurological damage related to her disease, with dependence on mechanical pulmonary ventilation a possibility.
Opinion: As it appears in the consultation, in fact, the adoption of measures to limit procedures and treatments that prolong the life of the patient in the terminal stage of severe and incurable disease, respecting the will of the person or their legal representative, “has all the ethical, moral and legal support in Brazil”.
6) Cremesp Opinion 90.198/2010 18 – Communicating death to family members
Consultation: the communication to the patient of a newly concluded diagnosis or even in the case of death is the responsibility of which professional: the doctor, the psychologist or the nurse?
Opinion: We understand that explaining the results of an examination, or informing a diagnosis, or clarifying and satisfying all the doubts of the patient or family member are actions within the competence of the physician, the coordinator of the health team, and the individual who is most responsible for the quality of care given to the patient’s illness. Particularly in relation to the information given to relatives regarding the death of a certain patient, it seems fundamental to us that it is given by the person in charge of the health team, the doctor; except in those cases where another professional is more suitable, from a professional point of view, to perform this challenging function. These exceptions will always take into account the best conduct for the particular situation.
7) Cremesp Opinion 124.460/2010 19 – Free and Informed Consent Form in clinical practice
Consultation: if the clinical director can make the completion of an informed consent form compulsory for the institution’s medical professionals.
Opinion: It is obligatory that the medical record should include the clarifications provided and the consent of the patient. We do not find it reasonable or necessary to obtain the patient’s signature for any and all medical procedures. On the other hand, nothing prevents the FICF from being used in certain departments or medical departments to perform invasive diagnostic exams, surgeries and more aggressive therapies. It is not possible for a clinical director to alter the guidelines by requiring that the FICF is used in all procedures or determined procedures.
8) Cremesp Opinion 155.608/2011 20 – Medical conduct in the case of abandonment of post-operative follow-up treatment by patient
Consultation: On how to prove, in a legal and ethical manner, the abandonment of treatment by the patient.
Opinion: In complying with all the duties listed, in addition to maintaining a respectful and polite relationship with his or her patients, the doctor will hardly be the victim of any unethical maneuver on the part of the patient. If, even if acting correctly, the doctor is the victim of an artificial and immoral maneuver on the part of the patient, our courts, in the full state of law, will certainly punish the guilty parties in the inevitable ethical and judicial litigation to which all who practice the Hippocratic art are subject.
9) Cremesp Opinion 138.679/2012 21 – Confidentiality of medical records
Consultation: a family frequently questions the treatment given to a hospitalized patient with a serious health condition. The medical team wants guidance on how to proceed in the case, and to know whether if the patient dies, the attending physician should sign the death certificate or refer it to the Death Verification Service (DVS).
Opinion: The attending doctor, responsible for the patient and the leader of the multidisciplinary team, should be responsible for communicating with the patient, and should always seek his or her best interests. This doctor has the commitment and the duty of vigilance, of information and of obtaining consent for all the acts practiced. The family can and should be informed, but the commitment of the doctor and the medical team is to the patient, including in terms of protecting the patient’s privacy. The family should be informed of the bioethical referential of confidentiality to which the patient is entitled and that they may have restricted access to the medical records if the patient wishes. If authorized by the patient, this access must be given to the family members. If the patient, for whatever reason, loses all or part of their autonomy, and the attending physician considers them incapable of making autonomous decisions, the medical professional must then verify who can represent the patient when communicating with the team and inform and discuss the therapeutic proposals with that person.
10) Cremesp Opinion 18.688/2012 22 – Living will
Consultation: Regarding the non-obligation of doctors to prolong the life of terminal patients.
Opinion: Recognizing that the patient has a right to a dignified death, and to choose how and where to die, and refuse or request certain treatments, medications and interventions, as well as to interrupt them, it is legally possible for a document to exist that ensures the constitutional guarantee of his freedom, including of consciousness. But while there is no legal model, formula or legal prediction of the contours to guide the same in the legal order of the country, there is also nothing to the contrary that prevents its preparation to the extent of predicting the behavior that should be observed. But fundamentally, more than a document that appeals to formality, this should be the result of a process involving patient, family, medical assistants, religious faith, constructed with the awareness of everything that surrounds our will and desires, with respect to individualities, and matured with the understanding of our finitude.
