State reform; descentralization and municipalization of teaching in Brazil: the political administration of educational public systems after LDB 9.394/46

This article intends to analyze the brazilian state restoration course and its relation to decentralization of education by municipalization and, consequently, the challenges put to Municipal Education in Brazil, giving emphasis to 1996-2002 period.It finds out that the challenge put to the regime of collaboration and Democratical Administration of teaching public systems in Brazil sets up itself through definition and consolidation of possible strategies that account for democratic content shown in constitutional texts so that it establishes its political institution and legal acts in local field such as Municipal Organic Laws, Municipal Educational Board and Social Attendance and Control Councils too. It concludes that municipalization, the way it appears today, keeping crucial power centralization at Federation, made what is named technical and political division of Basic Educational Administration,destroying the responsible figure of collaboration that has pointed out, meaningfully, the democratical progress of new relation between powerful federate region not only concerning to the 1988 Federal Constitution but also concerning to the new Educational Directive Law from 1996.
