GRAMMARS OF LAW IN TENSION: DISPUTES OVER PUBLIC EDUCATION IN BRAZIL

ABSTRACT

Reactive juridification is the deepest axis of deconstruction of the idea of public, free, secular and social quality education as a universal and unavailable right. Its origin is the (neo)conservative restoration in Latin America, a transnational reaction that articulates Christian activism with non-religious political actors in opposition to the egalitarian legal advances achieved by feminist, LGBTQI and anti-racist movements. The article conceptualises this process as an arena of legal and symbolic disputes and as a cohesion strategy of different neoconservative movements that have in the foundations of the right to education a privileged field of action, as shown by the cases of juridification analysed in Brazil.
