Restitution and Indigenous Slavery in Vasco de Quiroga’s Información en Derecho (1535)

ABSTRACT

In this article we seek to show how the issue of slavery, already understood as a problem, will be faced from a legal and moral theory of restitution in its philosophical foundations. The concept of Restitution, probably one of the most important and enduring concepts of the practical philosophy of the second scholasticism, is a sample of a composition of arguments at the interface between ethics, economics and law that marked the political theories of the Baroque period. Here we’ll see the peculiar way that the jurist and theologian, magistrate and bishop of Michoacán, Vasco de Quiroga (1470-1565), deals with the issue of slavery and restitution in his Información en Derecho (1535).
