DISPUTED TERRITORIES: COMMENTS ON THE COUNTER-REPORT PREPARED ON THE POTRERO GUAÇU INDIGENOUS LAND

Abstract

This article aims to understand the dilemmas and frictions in the relationships between Anthropology and Law, which are established in traditional lawsuits about demarcation of Indigenous territories. Therefore, the technical assistance report prepared in the course of the judicial process of demarcation of the Potrero Guaçu Indigenous Territory, occupied by Guarani Indigenous people in Mato Grosso do Sul, will be analyzed. To carry out an analysis, we sought to identify the main concepts exposed in the aforementioned report, and confront them with an established literature on the subject. In this way, we sought to demonstrate which for an effective device of land disputes about Indigenous territories, knowledge about the judicial procedures is not enough. In addition, it is necessary to understand the specificities, knowledge, methodologies and techniques that allow the anthropologist expert to prepare a scientifically based report, so that an adequate assessment of the expert evidence can be carried out in this context of land conflict.
