The undesirable inclusion: the Brazilian firms and the law of quotas to be reserved to the disable people in the labour market

The article addresses the law governing employment quotas reserved for disabled people in the Brazilian labour market, emphasizing the low receptivity or support provided by companies involved in the process and especially in terms of control by the Ministry of Labour (MPL). The research has been conducted with one of the Regional Labour Prosecutors of the MPL, more specifically, the RLP of 3rd Region of BeloHorizonte. This study involved all legal notifications related to the neglect of legal standards issued by the RLP over the period 20002007. The obtained results help to clarify the maindefensive strategies adopted by companies in order to evade, defer or minimize the compulsory recruitment of disabled people. In addition, the outcomes reveal the selectivity inherent in constrained recruitment imposed on companies in which there is a clear prioritization of physically disabled people not in wheelchairs with respect to other types of disabilities.
