Judicial control of pharmaceutical care policy: law, science and technology

To identify mechanisms to reconcile the law and technical standards, we considered the concept of health and the characteristics of the democratic state. Taking the example of Brazilian standards of pharmaceutical care policy, we concluded that legal rationality is required to verify if their development followed the constitutional requirement that demands the "community participation", establishing a democratic and judicial control.
