This paper addresses the right children and adolescents have to live as members of their families. Moreover, in the light of Socio-historical Psychology, it discusses the affirmation process regarding new child, adolescent and family concepts in the Brazilian society, as well as the judicialization process involved in family relations. Among protective measures, this paper brings the institutionalization of children and adolescents to the foreground, exposing the contradictions and paradoxes of such measure in regard to family life assurance.
