JURIDICAL PERSONALITY OF LEGAL PERSONS: DOGMATIC EVOLUTION

Abstract

The study of juridical personality, especially if it involves legal persons, is particularly relevant nowadays and has been widely discussed in the history of both national and international juridical thought. However, the nature of legal person has always divided theory, and there have been authors who wrongly denied the existence of a legal personality, as an autonomous entity. Assuming that juridical personality corresponds to the ability to hold autonomous juridical relations and that persons in Law are those who may hold rights and obligations, legal persons are thus provided with juridical personality. Thus, the present study aims to analyze the history of juridical personality in Portuguese Law, from its origin to the definition used currently, which looks at this concept as an organization that consists of a group of people or property set, engaged in the achievement of common interests.
