Migrant subject of law: equality and discrimination

Abstract

This article examines unjustified inequalities and discrimination in Law and institutional practices towards migrants, refugee and refugee claimants in Brazil. This is an exploratory study, supported by the analysis of specialized literature on legal equality and antidiscrimination law. It uses data and normative documents as empirical material in conjunction with the theoretical references. It questions the way in which the legal principle of equality is treated, in a broad and abstract way, to demonstrate that the mere prohibition of unfair distinction by the law is insufficient to counteract the maintenance of unjustified inequalities and discriminatory legal forms. The article seeks to offer a critical reflection on Law in terms of equality and the legal category of the abstract subject of law, and give it concreteness in Brazilian society. The main driver of this analysis is the denial of the exercise of citizenship as a result of being deprived of political rights and facing obstacles in having recognized their university education acquired in another country. The life of the migrant subject of law is thus intersected by direct and indirect discriminations by the Law and by the realms outside of it.
