Hegemonic globalization and neoliberal criminal policy

Abstract

Contrary to the optimism of critical criminologists of the 70s, the last decades are marked by punitive rise and hiperencarcerament. With that in the background, this article seeks to complement the studies, using the text The processes of globalization, by Boaventura de Sousa Santos, knowing that it doesn’t deal with the criminal issue, but enables dialogue and reflection on external elements and proposes to think about the transformations of the world. The research problem starts from the question: What is the intersection between neoliberalism and criminal policy? Thus, with theoretical and bibliographical research, the text of Boaventura is combined with theoretical framework of critical Criminology. The objective is to demonstrate connections between hegemonic globalization and neoliberalism with the criminal control and criminal policies of law and order and zero tolerance. The hypothesis is that hegemonic Globalization provides the context and connections for the rise and the introduction of neoliberalism as a rationality, and, above all, instill in criminal politics the logic of hiperencarcerament imported by peripheral and dependent countries like Brazil.
