Abstract
With this paper I intend to contribute to spinozistic legal researches that already exist and encourage new iniciatives, by the confrontation of epistemological questions and, consequently, questions of method. There are legal and philological canons that, if not safely faced, can block the development of such researches and the possible interest in new ones. The object of the text is to expose the obstacles, make their criticism and, at the same time, suggest ways of overcoming. The two major problems are these. First: how can be qualified as “legal” researches based on Spinoza’s work that do not offer doctrinal solutions? Second: how can we theorize today, thinking about our contemporary problems in Brazil, with the help of a work from the past, a different context, such as Spinoza’s work?
