Arguments and facts at the Brazilian Supreme Court: examination of condemnatory criminal judgments.

Abstract

This paper analyzes the argumentative performance of the Brazilian Supreme Court in the judgment of criminal charges from the examination of condemnatory penal decisions handed down from 6/June/2014 to 6/June/2016. Some issues related to the set of decisions in exam are discussed, including the problem of exposure and assessment of the evidential facts and the breaking of the principle of immediacy
