The paradox as politics: an actualization proposal on Wendy Brown’s critique of rights

Abstract

This article aims to present Wendy Brown’s contribution for a critique of rights. The author’s insertion in the debates on the emancipatory value of of rights, envolving the multiple positions and theoretical trends around the critical fields and different actor beloging, or contending, the authors known as memers of the Critical Legal Studies is the point of departure for the reconstruction of her arguments. From that, we claim that it is relevant to expose some of this theoretical disputes, to defend that it has a positive aspect of coming back to Brown’s production on rights from the 1990’s for the present times From that, we aim to show that these approaches are not dated. They can contribute to sophiscate Brown’s diagnosis of the present times, regarding the positioning of rights in contemporary neoliberalism.
