Insurgent Law: Marxist Foundations from Latin America

Abstract

This article presents the thesis of Insurgent Law, conceived as the synthesis between the Marxist critique of law and the praxis of the social struggles of popular movements. With the fundamental inspiration of the work of Marx (and his followers, notably Pachukanis), he also welcomes critical Latin American social thought and proposes a tactical use of law combined with a strategy of extinction.
