Abstract
The congressional form of the constituent of 1987 was not a consensus among the oppositionists of the dying regime and the pro-regime. This paper tries to analyze if in this dispute of form of constitutional construction there was also a confrontation on the passage of time and its control. A theoretical research will be carried out on the historical process of the constitutional construction of 1987 and the use of critical formulations on a relation between law and politics in the category of constituent power.
