Stay home? Forced evictions and Covid-19

Abstract

The purpose of this paper is to verify if the Supreme Court, Superior Court of Justice, Federal Court of Appeals of the 2^nd Circuit and the Rio de Janeiro State Tribunal considered the Covid-19 pandemic when judging repossession and possession lawsuits between 02/06/2020 and 06/02/2021, and whether international standards on forced eviction were observed. After analyzing 291 decisions, we observed that the pandemic was not mentioned in the majority of the decisions and that international parameters were ignored.
