Magna Carta is not synonymous with Constitution: an analysis of the concept in Brazil and a brief history of the medieval document

Abstract

The Magna Carta of 1215 is customarily cited in Brazil as a synonym for the Constitution. Starting from the conceptions of the functions of the legal history of Hespanha and the criticisms already presented by Herzog about the contemporary use of the Magna Carta, this article aims to compare the Brazilian descriptions of the document with a historical research.
