The conception of education in the first half of the nineteenth century through the Napoleonic Code

Abstract

This study aims to place the education topics in reflection about the legal inheritance of the Ancient Regime and French Revolution in the first half of the nineteenth century. Before the education is seen as a social problem, and therefore the main State’s interest, the subject was treated as an element belonging to the domestic sphere and linked to parental authority. It is intended to understand how the Napoleonic Code regulated the relationship between parents and children, distributing rights and responsibilities between them, and also check the attitude of the courts and doctrine regarding the education of children.
