Abstract
The article initially analyzes the ambiguity of the amnesty and redemocratization process in Brazil. Next, the focus is on the role of the judiciary in both the judicialization of repression during the dictatorship and in the amnesty process. In the third section is provided a brief characterization of the institutional rupture occurred in Brazil in 2016 and a discussion about the nature of this rupture. Finally, in a concluding tone, we identify relationships between the mentioned processes.
