Political Violence and Transitional Justice in Brazil: Disputes Around the Memory of the Recent Political Past

Abstract

Brazilian justice not only neglected the human rights violations perpetrated by military during the authoritarian regime, but overruled the thesis that the impunity of the executioners was an indispensable condition for consolidating of democracy. Based on the analysis of the 1979 Amnesty Law, the institution of the National Truth Commission in 2011 and the military memorialistic project on the lead years, we discussed the fabrication of this argument and its relationship with the constitution of a device of power capable of guaranteeing a privileged political condition for the military, even under the aegis of the democratic regime.
