An alchemical effect: on the use of rights discourse by black people

Abstract

Patricia J. Williams is a jurist and black North-American intellectual. In this paper, I specifically approach the conception of the author on the use of language or rights discourse by groups subordinated in function of their race. Such focus, in addition to allowing the reflection on the theme within Brazilian legal production, will also contribute so that the study can achieve two objectives: to present the main characteristics of the author’s theorization process and to enable us to know one of the fundamental topics of the controversy between the Critical Race Theory and the Critical Legal Studies.
