With how many strokes does a constitutional crisis take place in Brazil? Abusive constitutionalism, Constitutional stress and constitutional legality.

Abstract

The article analyzes how the concept of abusive constitutionalism has been approached and applied to the Brazilian reality. Then, the concepts of constitutional crisis and constitutional stress are explained in order to make a diagnosis regarding the constitutional health of Brazil after impeachment. For the development of the research, the hypothetical-deductive method was used and as for the procedure, we adopted a bibliographic investigation with a qualitative approach. As conclusions, the insufficiency resulting from the importation of a North American exam for the understanding of the functionality of the national constitutional policy is highlighted and that the disputes over the constitutional interpretation erupted from the impeachment of 2016 enabled the redefinition of the constitutional legality, in order to corroborate the (non-electoral) alteration of government projects and the rise of a candidate from the populist right to the Presidency of the Republic and to aggravate the interpretative disputes over the Constitution.
