Fascism through Pachukanis eyes

Abstract

This review addresses the four texts that make up the collection Fascism, published in Brazil for the first time in 2020, by the Soviet jurist Evguiéni B. Pachukanis. Forming a collection of texts produced in different periods and about different experiences, it has a double purpose for the reader of legal theory and legal history: first, it presents a very sophisticated and detailed analysis, from a jurist's point of view, about Italian fascism and German fascism, pointing out their internal distinctions, as well as their difference from the Bolshevik experience. Secondly, the text can be seen as a source in itself for the legal historian, as one can observe the clashes between him and other legal theorists of the period, as well as Pachukanis' own rhetorical and stylistic changes, fruit of his effort to adapt to the advancing process of Stalinization of the Soviet Union.
