The last crisis of legitimacy of the constitutional jurisdiction in Spain

Abstract

The Constitutional Court is facing one of the biggest crises in its history, due to the constant politicization of the body, baseda on the justifications that are made when appointing magistrates and, thanks to a legal system that does not require too many requirements when carrying out the function: be a lawyer of recognized competence and have fifteen years of professional practice. In this work, its legitimacy will be questioned based on the lack of independence and neutrality of its magistrates and the constant detriment of the collegiate nature of the body due to the practices that take place within it. Also, it will come to be argued that we have a dysfunctional Constitutional Court due to the past personal situations of its magistrates, both political and institutional, based on the doubts that are displayed regarding its legitimacy.
