Abstract
This article is about contemporary actions performed by the Brazilian State, focusing specifically on the conflict between freedom and legal certainty, and how this tension shows itself in the political and legal guidelines for the formation and development of the Law Enforcement State, later State of Law, and the current repercussions on Administrative Law, particularly when there are roles assigned amongst state and free enterprise.
