Hierarchy between complementary and ordinary statutes: a proposal for a solution of the problem based on Merkl’s theory of the staircase-like construction

Abstract

Merkl’s theory of law’s hierarchical structure is utilized to analyze and propose an answer to the question of the hierarchical status of complementary statutes and ordinary statutes. Initially the traditional views on the subject are presented. Then Merkl’s theory of law’s hierarchical structure is explained. Finally, Merkl’s theory is employed in order to deal with the question about the hierarchical status of complementary statutes and ordinary statutes.
