Constitutionalisms in a three-dimensional perspective

Abstract

This paper studies constitutionalism from Philosophy and Legal Theory, using the framework of a tree-dimensional theory. It analyses the context of discovery of this legal model, the complexity of its origins and the Latin American scenario. It addresses the context of justification in order to corroborate the thesis of the three-dimensionality of this legal phenomenon: the distribution of power and strategic alliances (facts), human rights as an instrument of positivity, and the axiological standards. It also investigates the current application context of this model, observing the sociological, normative and axiological implications and the future of constitutionalism in Latin America.
