This paper aims to analyze the crisis faced by the State, more specifically by his arm directed to handling conflicts, ie the Judiciary. Accordingly, we will observe the foundations of the modern state in the light of Hobbesian philosophy for, from the concepts it understood, to analyze the characteristics that make current mechanisms of Justice as an institution, as well as the elements that trigger, in this text, we understand how crisis.
