Abstract:
This article aims at analyzing how the Judicial Department deals with the social issue, in the processes of adjudication of insanity. Judging the social issue is accomplished by transferring the Executive Department's responsibilities to the Judicial Department as to guarantee the social rights in the process of adjudication, which ultimately deprives the interdicted of the enjoyment of their civil and political rights. We have concluded that such a procedure reveals the state's conservative and coercive aspect, under a new guise.
