Establishing a court “in times of crisis”: the installation of the Pernambuco Court of Appeal between conflicts and Justice projects (1821-1822)

ABSTRACT

This article proposes an analysis of the process of creation and installation of the Court of Appeal of Pernambuco, between the years 1821-1822. The interest in establishing a relationship in the captaincy was manifested by the local elites since the 17th century. On February 6, 1821, in view of the political and social situation opened up after the beginning of the Portuguese constitutional movement, the king authorized the creation of the court. However, the installation process was guided by political disputes and interests between groups in Brazil and Lisbon, led by the deputies of the Constituent Courts. The Pernambuco Court of Appeal became operational on August 13, 1822, after debates and the presentation of conflicting political and justice projects that characterized the process of political emancipation in Brazil.
