The article discusses the legitimizing process of the dictatorship regime established in Brazil in 1964, during the period between the March 31 coup of that year and the publication of Institutional Act n.5, in December 13, 1968. The emphasis is on analysis of the preservation of democratic-representative institutions. Specifically, it examines the relationship between the military in the exercise of Executive Power and the Legislative, the option for the preservation of this institution as a way for the construction of legitimacy, since they indicate the democratic commitment of the regime, and the conflicts resulting from this choice.
