WHEN THE LAW IS NORM: AN ANALYSIS OF THE CHILD AND ADOLESCENT STATUTE AND OF BRAZILIAN JUVENILE JUSTICE´S EXAM NARRATIVES.

Abstract

This article analyses the Brazilian Child and Adolescent Statute - ECA in its section on the infraction act and the magistrature and prosecution´s exam narratives in the juvenile justice system. It is understood that ECA and exam narratives are forged with the disciplinary power, in the logic that concerns it, comprising vectors for its expansion. The articulation between this power and the ECA law, as well as between it and the narratives, is exposed. Finally, the profile/type of adolescent susceptible to greater punitive intensity within the socio-educational system is given visibility. The notions of society/disciplinary power and examination thought by Michel Foucault are orienting guides of this reflection.
