Abstract
Artificial intelligence and the internet of things, direct heirs of the earth-shattering fourth industrial revolution, are bound to be seismic shift in the purview of criminal procedure, which will be transmogrified beyond recognition. This paper aims, concretely, to pore over the difficult trade-off between artificial intelligence and the defendant´s fundamental rights in the remit of criminal procedure law. Chiefly the defendant´s right to mental privacy, which derives from nemo tenetur se ipsum accusare. This paper endeavours to flesh out the great bulk of these ground-breaking changes, which are shaping up to take place in the remit of criminal procedure law.
